Payment Policy
Cancellation Policy
By booking, purchasing, or otherwise reserving a training session, the active party agrees to this Cancellation Policy. Cancellations must be made in writing more than one (1) month before the time a training session is scheduled to begin to receive a 100%* refund of your payment, *minus the original transaction or *processing fees; in two (2) weeks before the time a training session is scheduled to begin to receive 75%* refund of fees; in five (5) business days before the time a training session is scheduled to begin to receive 50%* refund of fees. The cost of the class will be forfeited if cancellation to received after the aforementioned dates. SevenGen is not obligated to do so but may use its best efforts to reschedule that student’s class. Rescheduling on behalf of a student’s availability may only be considered for the original registered student. Any refunds for training courses canceled in violation of this Cancellation Policy shall be provided at SevenGen’s sole discretion.
SevenGen reserves the right to cancel a course up to two weeks before the scheduled date due to not filling the minimum required student seats. In this occurrence, SevenGen will reach out to all participants concerning the schedule and offer to reschedule that registered student in the next available course of the same title or within the next six months. Courses canceled by SevenGen will also offer an alternative option to receive a 100%* refund in place of the rescheduled course.
Cancellations Due to Weather
For all scheduling changes caused by weather conditions such as extreme storms, flooding, blizzard, earthquake, etc., SevenGen will reach out to all participants concerning the schedule and offer to reschedule that registered student in the next available course of the same title or within the next six months. Courses cancelled due to weather conditions will also offer an alternative option to receive a 100%* refund in place of the rescheduled course.
Cancellations Due to Unforeseen events at the Host Venue
For all scheduling changes caused by unforeseen events at the host venue such as power outage, water supply issues, lock down, fire, gas leak, etc., SevenGen will reach out to all participants concerning the schedule and offer to reschedule that registered student in the next available course of the same title or within the next six months. Courses cancelled due to weather conditions will also offer an alternative option to receive a 100%* refund in place of the rescheduled course.
Training Anniversary Dates
For all “Refresher” courses an anniversary date is required upon enrollment. The registered student’s anniversary date must meet the time frame requirements as established by the governing agency: EPA, DOT, or OSHA. An extension will be considered on a case-by-case basis if a registered student can provide documentation from the governing agency on a certification extension. Anniversary dates are hard deadlines. If a training anniversary has passed and no additional documentation is presented, the student’s enrollment will be considered an “Initial” course instead.
Conduct
Any disorderly conduct is forbidden. No damage should take place to the host property or SevenGen’s equipment or technology. There shall be no horseplay, fighting, or other forms of violence enacted upon other students, the instructor, or others at the host venue. Any instances where such events take place will result in that student’s removal and forfeit of class seat and any refund. In an event where damages are enacted upon host property or SevenGen property, the assailant will be liable for all damages. SevenGen reserves the right to remove any student from the class and have security personnel escort individuals off property.
Drug, Alcohol, and Tobacco Use
All drug and alcohol use is prohibited before, during, and after the training event while the registered student is on the host property. This includes but is not limited to use in the host building or other adjacent structures, use on host grounds, or in personal vehicles. In designated outdoor areas, the host venue exclusively permits smoking tobacco. All discarded butts should be placed in the designated receptacle.
SevenGen’s Disclaimer of Warranties
SevenGen provides the training course on “as-is” biases. Our professionals are subject matter experts in their fields, and we strive to stay up to date on the latest information. The information, exercises, and resources presented during training are based on the most accurate information at the time of the event.
Limitation on Liability
SevenGen will not be held liable to you or any other person or entity for any claims, damages, judgements, liabilities, costs, charges, or fees, including attorneys’ fees, whether in tort, contract, personal injury, or strict liability, including, but not limited to, indirect damages, consequential damages, exemplary damages, incidental damages, statutory damages, special damages, or punitive damages, even if SevenGen has been advised of the possibility of such damages.
Payment
All payments for courses are due upon registration. You (the registered student) hereby authorize SevenGen’s payment processing agent to charge your credit card. You agree that You will pay all costs of collection, including legal fees, incurred by SevenGen if it is forced to expend resources collecting any monies owed to it by You.
If You dispute the amount or validity of any payments made under these Terms, You must notify SevenGen within ten (10) business days of any such dispute. You understand and agree that by failing to notify SevenGen of any dispute within ten (10) business days you will expressively waive any claims related to or arising out of the disputed payment.
*Service Fees
A 3% and .30 cent nonrefundable service fee is included in each payment. BY USING THIS SERVICE, YOU AGREE TO PAY ANY ASSOCIATED SERVICE CHARGES. The service fee is not refundable, even if the payment to which it relates is canceled, refunded, credited, or charged back.
SevenGen will not be liable or responsible for any injuries, mistakes, violations, or regulations promulgated by any regulatory agency, such as OSHA, DOT, and the EPA, or other errors in the workplace that occur after a party has utilized SevenGen’s services.
Transaction Information
To process transactions, we collect information related to each transaction, such as the amount and the necessary identifying information, including the account numbers or email addresses of the parties involved.
During the processing of transactions, we collect verification information from the credit card issuers. The credit card service verifies that the user’s credit card information and address match the information that the user supplies.
Notices
SevenGen may give you notices by email. Notices can include receipt of registration, information about your transaction, information related to class location, delay or cancellation of event based on weather or other unforeseen circumstances.
